Terms of Service

1. Agreement to Terms

By accessing dmcplanning.co.uk or engaging DMC Planning Ltd for services, you agree to be bound by these Terms of Service. If you do not agree, you must cease use of our services immediately.

2. Services

DMC Planning Ltd provides town planning consultancy, architectural design advice, and development strategy services. While we use our professional expertise to maximise the chances of success, we cannot guarantee planning permission, as final decisions rest with the Local Planning Authority (LPA) or Planning Inspectorate.

3. Fees and Payments

  • Fees are quoted in British Pounds (GBP) and are exclusive of VAT unless stated otherwise.
  • LPA submission fees and third-party disbursements (e.g., heritage reports, flood risk assessments) are payable directly by the client or re-invoiced at cost.
  • Invoices are due within 14 days of receipt. We reserve the right to halt work on overdue accounts.

4. Client Obligations

To ensure the best outcome, you agree to:

  • Provide accurate and complete information regarding the property and project history.
  • Respond promptly to requests for instructions or approval.
  • Grant access to the property for site surveys as required.

5. Intellectual Property

All drawings, reports, design statements, and advisory documents produced by DMC Planning Ltd remain our intellectual property until full payment is received. Upon payment, you are granted a licence to use these documents for the specific project and site intended. You may not reuse them for other sites without our written permission.

6. Limitation of Liability

Our liability is limited to the professional fees paid for the specific instruction. We are not liable for consequential losses, delays caused by third parties (including LPAs), or changes in planning policy that occur after our advice is given.

7. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
